IA Intellectual Property

Insight Assessment is a distributor of high quality tests and surveys. As such, Insight Assessment is committed to deliver the tests or surveys its clients have assigned to their test-takers in an accurate and timely manner. Insight Assessment is also committed to providing for its clients accurate test scores, survey results, and reports of such demographic information as is entered by test-takers in response to the questions on their assigned tests or surveys which those clients have contracted with Insight Assessment to deliver. As standardized testing has become more prevalent and in some cases more high stakes, and as culturally the sensitivity to the privacy of personal information has grown, it becomes increasingly important for the protection of our company, our clients, and our test-takers for Insight Assessment to notify all persons of a number of important matters. Thus the following notices are hereby published and made public.

Notice: A prospective client must assure Insight Assessment that

    • Provisions will be made to guarantee test security.
    • Copyrights will not be violated; no copies of the test, in whole or in part, will be made.
    • Neither the tests nor the test results are sold or made available for sale or resale.
    • Tests are administered correctly, as specified in their User Manuals.
    • Test data are analyzed and interpreted correctly, as indicated in their User Manuals.
    • Test results are used ethically and responsibly.
    • If test data to be used are data collected by some other Insight Assessment client,
      that client must grant permission for those data to be used by this student in this project.
    • Due to the significance of test security, Insight Assessment reserves the right to discontinue services or decline purchase requests in the event that there is reason to be concerned that doing otherwise would compromise the security of any of its measurement tools.

Notice: Purchasers and users of Insight Assessment measurement tools incur by virtue of their purchase of said tools certain obligations and responsibilities, which are specified on this website.

Notice: Insight Assessment CapScore™ answer forms, materials and services, and Insight Assessment's On-Line E-Testing software, and its code, images, and web content are protected by international copyrights and renewals (c) 1986, 1990, 1992, 1994, 1998, 2002, 2006, 2008 held by The California Academic Press d.b.a. Insight Assessment and the authors of the various tests. Insight Assessment / The California Academic Press publishes tests, surveys and their associated questions, items, and answer forms in English and in all translations all of which are covered by various US and worldwide copyrights held by the test authors. Tests, questions, items, or answer forms may not be reproduced in whole or in part in paper or electronically or by any means without consent and written agreement with the author(s) and publisher. Other tests, books, reports, slides, charts, graphs, or surveys distributed through Insight Assessment on-line or in paper-and-pencil format are protected by copyrights controlled by their authors, developers, or publishers and are made available through Insight Assessment with the appropriate permissions and authorizations.

Notice: All persons, including purchasers, reviewers, client users and test-taker users, are hereby notified that Insight Assessment tests, testing materials, computer-based test and survey software, and the testing or survey content delivered in paper form or by means of this software are protected by copyright law and international treaties. All copyrights worldwide are reserved. Insight Assessment E-Testing software, and its code, images, and web content are protected by international copyright (c) 2002, 2006, 2008, 2009 held by the California Academic Press LLC. D.b.a. Insight Assessment. All rights world wide are reserved. By accessing the IA e-testing system, user acknowledges that this computer-based test/survey software and the testing or survey content delivered by means of this software is protected by copyright law and international treaties. User agrees that reproduction or distribution of any part of this e-testing software or any test or survey delivered or made visible in any media by means of this software, or any question or answer, or any part thereof, is a violation of said copyright or copyrights may result in severe civil and criminal penalties, and will be prosecuted to the maximum extent possible under the law.

Notice: All persons are hereby notified that any unauthorized reproduction or distribution of any part of this e-testing software, or any test or survey, or any answer form delivered or made visible in paper, electronic, Internet, PDF, e-mail or in any media by any means whatsoever or any question or answer, or any part thereof, is a violation of said copyright or copyrights and may result in severe civil and criminal penalties. Insight Assessment will defend its copyrights and the copyrights of its test authors vigorously, and will prosecute violators to the maximum extent under the law.

Notice: Clients and test-takers are solely responsible for the interpretation and use of test scores, survey results, demographic information, or related descriptive information or statistical analyses as may be gathered, displayed, downloaded, or otherwise generated by Insight Assessment. User clients and user test-takers agree to hold Insight Assessment, its officers and staff members, individually and jointly, harmless of any liability or responsibility, financial, personal, or otherwise, for the use or the misuse of any Insight Assessment gathered, displayed, analyzed, downloaded, or otherwise generated test scores, survey results, demographic information, or related descriptive information.

Notice: Except for prepaid testing contracts and unexpired quotes, prices are subject to change without notice.

Notice: Clients are solely responsible for storage of returned CapScore™ results, data and datasets. If requested, Insight Assessment will search its CapScore™ data archives and retrieval datasets for clients. Contact Insight Assessment for cost information.

Notice: Insight Assessment is not responsible for verifying the identity of the test-taker, nor the truthfulness or the accuracy of demographic or other information as entered by test-takers. Insight Assessment is not responsible for the conditions under which tests are administered or taken. Detailed instructions for test administration are published in the User Manuals which are part of each test's specimen kit.

Notice: For test security reasons Insight Assessment does not publish or distribute answer keys, nor does it disclose which items or questions are used on the various subscales within its testing instruments. Although all reasonable precautions are taken to insure test security, Insight Assessment is not responsible for violations of copyrights nor for the unauthorized distribution of answer keys, whether they be accurate or inaccurate. Insight Assessment will vigorously prosecute the unauthorized release of scoring and answer key information to the full extent of the law.

Notice: Clients are hereby notified that The California Academic Press LLC, d.b.a. Insight Assessment owns the data derived from its on-line e-testing system and from CapScore™ and uses those data for research purposes such as the development of norms for various groupings of institutional types on various testing instruments, e.g. "US undergraduate student norms on the CCTST." Insight Assessment is committed to maintaining individual and client confidentiality of E-Testing and CapScore™ data and datasets. For further details see Data Security and Privacy.

Notice: Insight Assessment reserves the right to withhold testing and test scoring services or test score results for any client, test-taker, or other user who does not abide by these terms and conditions, does not follow test administration instructions, presents invalid answer forms for scoring, misrepresents or falsifies responses to test questions, cheats on a test, attempts to acquire or to distribute test questions or scales or answer keys, or who otherwise violates any of these terms or conditions.

Notice: We do not sell or supply tests to graduate students for purposes of classroom psychometric or educational analysis, evaluation, or critique.

Notice: Insight Assessment reserves the right not to sell to individuals who are enrolled in degree programs which use our tools for high stakes testing purposes or who are employees of client organizations which use our tools for high stakes testing purposes.

Notice: Insight Assessment strongly recommends that clients follow accepted ethical standards for the use and interpretation of standardized tests.

Notice: For test security reasons scales structures and item responses are not reported.

Notice: Insight Assessment reserves the right, at its sole discretion and without the obligation of prior notice or explanation, not to honor requests to purchase and requests to process scoring or report scores on its instruments regardless of the source of such requests.

Notice: In all testing situations, compliance with the requirements of the Americans with Disabilities Act are solely the responsibility of the purchaser of tests and testing services.

Notice: Dissertation Advisors / Committee Review or IRB Committee Review -- When either a doctoral advisor / committee or an IRB committee is reviewing a student's dissertation proposal or an independent scholar's research proposal, it is reasonable for the committee members to want to review the items in any surveys that will be given to the study participants. Therefore we do permit providing these committee members with a copy of the testing tool as long as they are cautioned about the protected nature of the instrument and are asked to assure that the instrument is not more widely distributed, and that they will either to return the copies to you or destroy them after the review process is completed. Doctoral students should also tell these committees that they must approve the instrument in its totality, as there is no possibility of editing or deleting individual questions or test items.

Notice: -- When filing a dissertation: It is not permitted to file a copy of the CCTDI along with the dissertation unless the library will assure, in writing and under signature of the library director, that they will not distribute this copy as a part of the dissertation (not by digital scan nor by hard copy) even if it is requested by other scholars. To include one of our testing instruments or any of the items it contains in a copy of a dissertation which is then distributed to a third party is both a violation of copyright and a violation of the contractual agreement for protection of the instrument that is assumed by the user at purchase.

Notice: Discussing an Insight Assessment testing instrument in a dissertation: You may include verbatim excerpts from the test manual, properly cited. You may also use one or more of the example items posted on our website to help your dissertation readers understand the nature of the instrument.

Notice: Publishing research papers from studies that use one of our Insight Assessment testing instruments: No actual test questions or test items from the instrument may be included within your publication. To include questions or items in a publication is both a violation of copyright and a violation of the contractual agreement for protection of the instrument that is assumed by the user at purchase. When discussing the instrument in your published paper, you may include verbatim excerpts from the test manual, properly cited. You may also use one or more of the example items posted on our website to help your reviewers and readers understand the nature of the instrument.

Notice: Insight Assessment testing instruments are used for high stakes testing in many settings around the world. When it is made available for purchase to doctoral students and independent scholars, the policy stated above is a condition of sale.
